TikTok’s Problematic Delivery Penalty Program: What You Need to Know

As music is increasingly utilized across digital platforms, ensuring transparency in distribution and copyright management is crucial to protecting the rights of artists, creators, and sound recording owners.
According to the latest announcement from TikTok, starting in November 2026, the platform will officially implement the Problematic Delivery Penalty Program. This is part of a new anti-fraud framework designed to enhance intellectual property protection for legitimate rights holders. Through this mechanism, TikTok aims to thoroughly curb unauthorized content distribution, thereby maintaining integrity and fostering a fair creative environment for the entire music ecosystem.
In its initial phase, the program will focus on penalizing a technical violation known as "Hidden Recording"
What is a "Hidden Recording"?
A Hidden Recording refers to the deliberate act of embedding part or all of unauthorized audio into another music file while falsely declaring the release metadata to bypass the platform's automated moderation systems.
Intuitively, if an individual does not own the rights to Song A but conceals Song A's audio within the audio file of Song B, and then registers and distributes it under Song B's information, this recording is classified as a Hidden Recording. This behavior not only distorts recognition data but also directly misappropriates revenue generated from the original work's rights.
Once a violation is identified by the system, strict sanctions will be immediately applied:
Financial Deductions: An administrative fee of $10 USD per violating recording, deducted directly from the partner's monthly royalty revenue.
Audio Removal: The recording will be blocked from TikTok's audio library and removed from the UGC (User-Generated Content) scanning system.
Revenue Freezing: All related usage streams during the violation period will be ineligible for revenue sharing.
How Should Artists and Sound Recording Owners Prepare?
Before the policy takes effect in November 2026, artists and distribution partners should proactively take 4 review steps:
Audit the Back-catalog: Review all music catalogs previously distributed on TikTok, especially remixes, mashups, or compilation tracks.
Match Metadata Accurately: Song titles, performing artists, and songwriter information must match the actual audio content inside the master file precisely.
Cleanse Audio Sources: Verify the legality of every sample, beat, loop, or vocal snippet used in the recording.
Prepare Licensing Documentation: Keep beat purchase agreements and sample license contracts ready to provide explanation materials when filing appeals through TikTok’s MediaMatch system.
